    These Terms & Conditions apply to all quotations, orders, sales and installations carried out by Superior Shutters Limited (“the Company”, “we”, “our” or “us”).

    By placing an order with us, you agree to be bound by these Terms & Conditions.

  2. Quotations

    All quotations are provided free of charge ad are valid for 30 days unless otherwise stated.

    Quotations are based upon information available at the time of issue and may be subject to amendment following a site survey.

    No contract shall exist until the quotation has been accepted and the required deposit has been received.

  3. Orders and Acceptance

    All products supplied by Superior Shutters Limited are manufactured to the Customer’s individual requirements and specifications.

    The customer is responsible for checking and approving all measurements, colours, material, styles, configurations and specifications shown on the Order Confirmation.

    The signed Order Confirmation shall be deemed acceptance of all details contained therein.

    Once an order has been placed, any requested changes may result in additional charges and revised delivery times.

  4. Deposit and Payment

    A deposit of 50% of the total contract value is payable upon acceptance of the order.

    Once manufacturing has commenced, the deposit becomes non-refundable as the products are manufactured specifically to the Customer’s measurements and specifications and cannot ordinarily be resold.

    The remaining balance is payable immediately upon practicable completion of the installation unless otherwise agreed in writing.

    The Copmpany reseres the right to suspend work or withhold delivery where payments are overdue.

    Interest may be charged on overdue accounts at a rate of 4% above the Bank of England base rate together with any reasonable costs incurred in recovering outstanding sums.

  5. Made to Measure Products

    All shutters, blinds, curtains, tracks and associated products supplied by the Company are bespoke and made to measure.

    The Customer acknowledges that onece manufacturing has commenced, the statutory right to cancel applicable to standard consumer purchases does not apply to goods made to theCustomer’s individual specifications.

    Any cancellation request received after manufacturing has commenced shall be at the company’s sole discretion.

  6. Surveys and Measurements

    The Company will carry out a survey prior to manufacture.

    Survey measurments taken by the Company shall be used for manufacturing purposes.

    Customers must notify the Company of any alterations to windows, walls, floors, furnishings or other features that may affect installation.

    Where custoners provide their own measurements, the Company accepts no responsibility for inaccuracies.

  7. Delivery and Installation

    Any delivery of installation dates provided are estimates only.

    Whil every effort will be made to meet estimated dates, delays may occur due to manufacturing schedules, shipping, customs procedures, supplier delays or circumstances beyond our control. Time shall not be of the essence.

    The Customer shall provide safe and reasonable access to the property during the survey and installation appointments.

    Additional visits caused by restricted access, customer-requested changes or incomplete information may be chargeable.

  8. Installation Conditions

    Installation may require drilling, fixing and adjustments to walls, window reveals, architraves and surrounding surfaces.

    Whilst every care is taken, minor filing, decorating or making good may occassionally be required following installation and shall remain the Customer’s responsibility unless otherwise agreed in writing.

    The Company shall not be liable for damage resulting from hidden pipes, wiring, structural dfects, loose plaster, defecive timber, unstable surfaces or any concealed condition not reasonably apparent during survey.

    Existing blinds, curtains and fittings should be removed prior to installation unless otherwise agreed.

  9. Window Handle and Existing Fixtures

    Where existing window handles, locks or fittings prevent the installation of shutters or blinds in the normal manner, replacement hardware of alternative installation methods may be required.

    Any additional costs associated with replaement handles, fittings or remedial works shall be chargeable unless specifically included within the quotation.

  10. Natural Materials and Colour Variations

    Natural timber products may display variations in grain, colour, textur and apprearence.

    Samples, photographs, brochures, websites and digital images are intended as guides only.

    Minor variations in colour, finish or textur between samples and finished products shall not constitute a defect.

  11. Removal of Installed products

    Where a Customer requests the removel if installed products following completion, the Company accepts no responsibility for damage to plasterwork, paintwork, timberwork, tiles, window reveals or surrounding surfaces resulting from such removal. Any repairs, making good or redecoration required following removal shall be the Customers.

  12. Warranties

    Manufacturer warranties apply to products supplied by the Company.

    Warranty periods vary according to product type and manufacturer.

    Warranties do not cover:-

    • Fair wear and tear

    • Accidental damage

    • Misuse or neglect

    • Excessive moisture or condensation

    • Exposure to excessive heat

    • Unauthorised repairs or alterations

    • Damage by third parties.

    Any warranty claim must be reported promptly upon discovery.

  13. Defects and Complaints

    Customers should inspect products upon installation.

    Any concerns must be reported in writing within 14 days of installation.

    The Company shall be given a reasonable opportunity to inspect and remedy any genuine defect.

    The Company is committed to resolving concerns promptly and fairly.

  14. Limitation of Liability

    Nothing in the Terms shall exclude liability for death or personal injury caused by negilgence, fraud or any liability which cannot legally be excluded.

    Subject to the above, the Company’s total iability shall not exceed tghe total value of the contract.

    The Company shall not be liable for indiredt, consequential or economic losses.

  15. Force Majeure

    The Company shall not be liable for delays or failure to perform its obligations where such delays result from ciscumstances beyond its control including, but not limited to:-

      • Supplier Delays

      • Shipping delays

      • Port congestion

      • Industrial disputes

      • Material shortages

      • Government restrictions

      • Severe weather

      • Acts of God

      • Retention of Title

      Ownership of all goods supplied shall remain with the Company unti payment has been received in full.

  16. Privacy

    Any personal information supplied to the Company shall be processed in accordance with our Privacy Policy.

  17. Governing Law

    These terms and Conditions shall be governed by and interpreted in accordance with the lasws of England and Wales.

    Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
